Hundreds join Kashmiri Pandit protest at Jantar Mantar

 

Hundreds of people today joined Kashmiri Pandits in their protest at Jantar Mantar today. The protestors belonging to all age groups and shades of life assembled in huge numbers and demanded that government take measures to punish the perpetrators of genocide, move away from tokenism and pass the genocide bill immediately.

 

Speaking to the press, Sumeer Chrungoo, President, Kashmir Samiti Delhi, said that if the government is really serious about the return of Kashmiri Pandits, than first and foremost thing it has to do is to recognise that Kashmiri Pandits are a the victims of genocide.

leading the group of youngsters wanted that the judiciary immediately act on the petition filed a Kashmiri Pandits to fast track the cases of killings and form an SIT. He said "any delay in justice weakens the faith of youngsters in the justice delivery system and mechanism"

 

Shilpi, a young student, who along with her friends had flown all the way from Mumbai to be part of the protest said that the happenings in Kashmir is an eye opening for all and if we don't punish the perpators, it will embolden the anti-India and jihadi forces to replicate the same across India.

 

Kashi Ram, a poor labourer and a rickshaw puller, had decided to forego his daily wage to be part of the protest and show solidarity with his fellow Indians and Hindu brothers.

 

Jahangir, a 40 year old Kashmiri Muslim, who was part of the protest said that "Kashmiri Muslims have also suffered in the hands of militants. Jihadis used our mosques against Pandits, commited heinous crimes against them. The truth is that our mosques, our relatives, our friends were spewing venom against the Kashmiri Pandit community and we were mute spectators in agreement to the genocide that was being committed. Our own people should have stood  up. I know Jagmohan theory is a lie and therefore today I came to support the Pandits."

 

The key demands of the protestors were

1. Recognise that Kashmiri Hindus are victim of genocide

2. Form Genocide Commission to fast track the cases and identify the perpetrators of genocide

3. Enact Prevention Genocide bill

4. Create 'One Place Settlement in Kashmir "in line with Panun Kashmir Resolution of 1991.'

 

The protestors carrying placards and banners raised slogans in favour of these demands.

Kashmir: an integral part of Bharatvarsh from the time immemorial

For many years, the separatists, the terrorist, the apologists and Pakistan have been propagating a lie to justify the Jihad in Kashmir by saying that Kashmir has never been a part of India or the Bharatvarsh. Not only have left liberals supported this lie, the intellectual class to has fallen for the lie and constantly used this lie to justify the crimes of terror in Kashmir, as an indigenous movement of a free nation. Unfortunately, the articles 370 and 35A helped this lie and even the innocent people not only in Kashmir but across India started believing in this lie.

Bharat etymologically is rooted in the verb Bha, which means light and rat which means devoted or immersed. So, Bharatvarsha is not just a geo-space but also a geo-cultural matrix from which various thoughts, concepts embedded in the depth of its consciousness of its people have emanated, giving shape to a great civilization called Bharatvarsha or India. Vishnupuran defines this land a country that lies north of the ocean and south of the snowy mountains. Thus, Kashmir is not only by geo-space definition but also because of geo-cultural matrix has been part of this great civilization and land from time immemorial.

The land Kashmir derives its name the great Indian Sage – Kashyapa. The story of Kashmir has Sanatan Dharma written all over it. The SSatisar as Kashmir was known earlier was given to Nagas  by Vishnu on the request of Wasuki (whose village ‘Waskur’ still exists in Gandherbal district), after they were losing out to Gaurda, their perpetual enemy. It is here that Jalodbhava, the demon was killed by the mother Godess after she came in form of a sparrow (ha-ri in Kashmiri) and crushed him under a hill. The hill still exists as Hari Parbat and the temple of Ha-ri too exists even now. It is here that on request of Sage Kashyapa, Nila, the King of Nagas allowed the Manu Putras to reside in Kashmir. The recorded history of Hindus of Kashmir dates back to almost 5200 years.

The Nilamat Puran, is probably the only puran which talks about a land and its people, starts with a question, ‘why did Kashmir not participate in the great war Mahabharta, where every King of Bharatvarsha did. The kingdom of Kashmir was no less than any other in the country?’ Nilmat says that King Gonanda was a relative of Jarasandha and he had joined him in his fight against Yadavas. Gonanda was killed by Balram and Gonanda’s sons Damodra went to fight Lord Krishna and was slain in the battle field by Krishna. Realising the sanctity of Kashmir, Bhagwan Krishna himself coronated the widow of Damodara, Yasmoti as the ruler of Kashmir. For the first time in the history of mankind, a female was made a ruler and Bhagwan Krishna herself coronated her. At the time of Mahabharta, Yasomati son was a minor, so Kashmir was exempted from joining either Kauravas or Pandavas. The Mahabharta, adi parva 2.64 states that sons of Pandu grew up in the holy mountains of Himavat. An area which many believe is Kashmir.

Every inch of Kashmir talks about its connection with Bharatvarsha. When Jalodbhava was to be killed, Lord Vishnu instructed Ananta to drain the water of Satisar by breaking the mountain barrier. The place Ananta did this is called Varahamula. Kashmiris still call it Varmul.

Kashmir has geographically been located in a difficult terrain and thus made the pilgrimage of Kashmiris to key tirthas spread in rest of India difficult. So, they created their own replicas of these key pilgrimage centres. Kashmir has its own Godavari, Ganga, Prayag and Sangam. Has Bhadrakali of Bengal, a temple of Tripura Sundari. And are used for the same religious activity the originals are used for. The gangbal of Kashmir has the same sanctity as Ganga of plains. It also flows from the locks of Shiva residing at the Kailash of Kashmir, Harmukh. The Sangam and Prayag have their Kumbhs and same religious activities as done at Allahabad or Nashik.

The land of Kashmir has had great contribution to the vedic civilization and won’t be unfair to call it ‘The Hub.’ Patanjali, the great commentator of Panani’s work often refers to the people pf Kashmir, whom he calls Kashmirikas. It is believed that Patanjali himself belonged to Kashmir. Many Puranas including Matsya, Vayu, Padma, Vishnu mention Kashmir. In the field of creative literature, the whole gateway of brilliant scholars were from Kashmir; Damodargupta, Jayanta, Somadeva, Bilhan, Kalhan amongst many others. It is here in this land that Somadeva wrote his magnum opus Katha Sarita Sagar.

Daughter of Sanskrit is what Dr. Toskhani calls Kashmiri. George Buhler, the most respected scholar of Indian Languages believed that Kashmiri descended from the Vedic speech, one of the dialects of classic Sanskrit.

Adi Shankaracharya, the great Saint and philosopher who in his desire to re-establish the faith in Upanishads decided to travel the length and breadth of this country. And part of his tour of this country, he decided to visit Kashmir also. It is here that Adi Shankaracharya accepted and acknowledged the importance of Shakti and wrote the beautiful Saundarya Lahiri on top of a hill that is today known as Shankaracharya Hill. In awe of Adi Shankaracharya, the Sharda Peeth (now in Pakistan Occupied Kashmir), the great Indian learning centre of those times, opened the never opened South Door in his honour. The targa, traditional headgear that Kashnmiri Pandit women wear is a gift from Adi Shankaracharya and symbolically represents crown as gift from ascetic.

Even today most of the Indians including Kashmiris start their day with a recital ‘Namaste Shaarade Devii Kaashmiira-Pura-Vaasini. Tvaam-Aham Praarthaye Nityam Vidyaa-Daanam Cha Dehi Me’. Salutations to you, O Sharada, O Goddess, O one who resides in Kashmir. I pray to you daily, please give me the charity of knowledge.

The Mahayana Buddhism had its birth in Kashmir. It is from here that Buddhism spread to China, Japan, Tibet and Korea. Even today China admits that India conquered and dominated the China culturally for 20 centuries without ever having to send a single soldier across her border. India conquered them, not Kashmir. Because even for Chinese, Kashmir has been a part of India form time immemorial.

The Kashmiri Pandits have seen many exoduses, some small, some big. It is a well-documented fact that there have been 7 major exoduses all driven by the atrocities of Islamic rulers or their officers. And where does one go to if driven out of home. One goes to a place where he/she is comfortable with. A place which practices his own religion, a place is part of his own country but safer. In 1990, Kashmiri Pandits did not go to flee to Pakistan, China, Tibet or Afghanistan. Most went to Jammu, a peaceful part of the J&K state and few others to the other parts  of India. Even in the earlier exoduses Kashmiri Pandits fled to other parts of India only. Although the exoduses brought suffering to them, they also did enrich arts and culture in many other parts of India. The Pahari-Kangra school of Art is one such example. The fugitive KP family who escaped the forced conversion, swept the region of Kangra and surroundings with their genius. While Seu Raina established the pre-Kangra style, his descendants led to the ultimate blooming of the style.

Kashmir has been part of many great Indian empires including those of Mauryas, Kushanas, Kamboj, Mughals, Sikhs and British India. Ashoka, the great King of India, founded the capital city of Kashmir, Shri Nagri, today known as Srinagar. The Shri is the honorific title for the Goddess Lakshmi, and the capital city of Jammu & Kashmir has been named after her.

It was on the outskirts of Srinagar that Kanishka, again a great Indian emperor, held the 4th Buddhist council. Kashmir is the birth place of what is known as Sanskrit Buddhism. The great scholar of Shaivism Acharya Abhinavgupta ancestors belonged to Kannauj and had moved to Kashmir on the request of the great Indian King, Lalitaditya Mukhtipida. Lalitaditya, a Kashmiri, is considered one of the greatest kings of India, whose kingdom extended from Karnataka in South to Orrisa & Bengal in East to Konkan in west and Afghanistan and many parts of central Asia in North.

With the advent of Islam, Kashmir saw the last of its local rulers. The first Muslim King dynasty in Kashmir was the Shahmir dynasty. The Shahmir himself was of Turk or Persian origin and sought asylum in Kashmir after he was banished from the SWAT region. Many Kashmiris are often heard saying that ‘Yusuf Chak was the last indigenous King of Jammu & Kashmir’. This is a blatant lie and highlights ignorance or deliberate mischief. The last indigenous King of Jammu & Kashmir was Maharaja Hari Singh. The Dogra rulers of Jammu & Kashmir claim to be descendants of Bhagwan Ram, an Indian God. The last indigenous ruler from Kashmir valley was Kota Rani. Chaks are not from Kashmir but are Dardis. And interestingly Yususf Chak was defeated by Mughals, who were invited to Kashmir by the famous Sufi Saint of Kashmir, Sheikh Hamza Maqdoom.

In the last 450 years of Kashmir’s history, expect for 67 years of Afghan rule, the state of Kashmir has been part of part of the Indian Empires including Mughals, Sikhs and British India. Maharaja Hari was of one of the many princely kings in the British India empire and his status was as same as the others. He was no different and like other princely states were subject to suzerainty of the British Crown exercised through Viceroy of India. In 1947, the Maharaja of Jammu & Kashmir signed the same Instrument of Accession as did other 569 princely states.

Such has been the foolish attempts to claim that Kashmir has not been part of India, when some of the most prominent Indian freedom fighters were Kashmiris; Tej Bahahur Saproo, Vijay Laxmi Pandit, Moti Lal Nehru, Kailash Nath Katju, Pandit Nehru, Indira Gandhi and even Allama Iqbal, the poet who wrote ‘Sare Jahan Se Accha.’ Infact India’s two prime ministers including the first, the longest serving and the first female were Kashmiris. It was a Kashmiri that set up India’s highly respected foreign intelligence wing R&AW. Kashmiris have served as Chief of Army, Airforce, Bureaucracy and various premier institutions of this country. Kashmiri is amongst the 22 scheduled languages of India.

The impure land – the failed state of Pakistan

On 14th August, 1947 came into existence a nation, challenging the 5000 years of India’s existence as a nation where every religion, every thought however contrary and diverse was debated, welcomed and allowed to flourish. Even the founder of Jamait -e-Islami Syed Abul A’la Maududi opposed the creation of Pakistan calling it a nation of Muslims and not an Islamic nation.


The history of Pakistan is chequered and the nation although claiming to be land of pure (Pakistan) is full of deceit and contradictions. Pakistan has never been honest in the ideals on which it was created and has been probably one of the cruellest state against the Muslims. The Muslims of the Pakistan have suffered more in Pakistan than in anywhere in the subcontinent.

The Indian state of Jammu & Kashmir, that Pakistan believes is the unfinished agenda of the Partition, was the first to face the brunt of ruthless Pakistan state when their army and their backed tribes invaded the princely state of Jammu & Kashmir, plundering the state and killing and raping thousands of Muslims of Jammu & Kashmir. The atrocities of the so-called Islamic army against the followers of Islam and the people they claimed they came to liberate, still sends shivers down the inhabitants of Jammu & Kashmir. The division of Jammu & Kashmir because of the intervention of United Nations, left one third of Kashmir under the occupation of Pakistan. Apart from Pakistan occupied Kashmir, the Pakistan also got to occupy the areas of Gilghit-Baltistan, the remote areas of the princely state of Jammu & Kashmir. These remote areas have seen the worse of the atrocities from the Muslim state of Pakistan. Senge Sering, Director of the Gilgit-Baltistan Studies based out of Washinton DC says “the rights of the people of Gilgit-Baltistan are being subjugated and the combine of China and Pakistan are looting the resources of the region.The police apparatus is mostly from Pakistan. When Pakistan’s National Accountability Bureau — an autonomous, federal body ostensibly meant to check corruption, but effectively keeps an eye on politicians on behalf of the army — wanted to open an office in Gilghit-Baltistan, it took over the only centre in the region for the handicapped”. He further alleges that “Pakistani Police are so ruthless that when the taking over of handicapped centre was protested by the locals and the local Law Minister spoke in their favour, a Pakistani soldier grabbed the Minister by the scruff of his neck and led him away. The minister later complained to the Chief Minister about the incident, but the CM said nothing could be done about it. That is how helpless and marginalised our people are.” (1)


In 1970 when the Awami League with large following in the erstwhile East Pakistan and now Bangladesh, won the national assembly elections decisively, the state of Pakistan refused to honour the mandate of the people and imposed martial law in East Bengal. Pakistan always practiced extensive economic discrimination against East Pakistan. Although East Pakistan generated 70 percent of Pakistan’s export revenue, the Pakistan government spending was much higher in West Pakistan and East Pakistan was regularly refused funds even for basic development. After the Bangladeshi started the civil disobedience movement against the blatant discrimination, the Muslim state of Pakistan used the most ruthless and brutal ways to subjugate the Muslims of east Bengal. The Pakistan Army under the direction of the state massacred around 3 million Bengalis. A Muslim state of Pakistan committed genocide against the Muslim citizens of its country. It is documented that General Niazi, the then military commander of East Pakistan had asked his men to rape every woman they see. ‘Iss haramzadi qaum ki nasal badal do (change the race of this community)” (2) was his instruction to his army men. What happened in Bangladesh is now being repeated in the Balochistan province of Pakistan. The Muslims of Balochistan who have been resisting the atrocities of Pakistan have seen killings of Balochis in thousands. While many Balochis have disappeared without a trace, many have been killed publicly and brazenly. Nearly 1,000 dead bodies of political have been found Balochistan province over the past six years. Activists say the figures, point to large-scale extrajudicial killings. Relatives say most victims had been picked up by security agencies. Thousands of people have disappeared without trace in Balochistan since a separatist insurgency gained momentum in 2007 (3)

The role of Pakistan in the Islamic state of Afghanistan has always been of a neighbour who would go to any length to foment and promote trouble. The support to Afghan Taliban, especially the Haqqani Network, has been the root cause the bloody war that has been waging in Afghanistan, result in the death of thousands of people in both terrorist attacks and the retaliatory attacks by the NATO forces. The NATO forces continued to bombard Afghanistan in their pursuit of Osama Bin Laden, while he was hiding comfortably in garrison town of Abbotabad in Pakistan. The Afghanistan’s President Ashraf Ghani recently said “the keys to war are in Islamabad, Quetta, Rawalpindi” – all cities in Pakistan (4) – suggesting the neighbouring country was a safe haven for cross-border terrorist activities.The sly Pakistan continues to soak its hand with the blood of innocent Afghanis, who are overwhelmingly Muslims.

India has the 3rd largest population of Muslims in the world. Many Organisation of the Islamic countries (OIC), including Bangladesh, Turkey and UAE have expressed the desire to include India as a member to the organisation. Addressing the OIC foreign ministers’ meet last year, the then Bangladesh foreign minister AH Mahmud Ali had said, “A number of countries — not OIC members — have a large number of Muslims as their citizens. Muslims may be a minority in those countries, but in terms of numbers they often exceed the total population of many OIC member countries. There is a need to build bridges with those non-OIC countries so that a large number of Muslim populations do not remain untouched by the good work of OIC. That’s why, reforms and restructuring are critical for OIC.’ (5)

The move has not been liked by Pakistan, the self-claimed global protector and the well-wisher of Muslims of the world. Pakistan has been totally against the move and has thrown many tantrums to block the induction of India in OIC. It even passed a resolution in their National Assembly to request OIC to neither include India in OIC and requested OIC to not even invite the nation with third largest Muslim population as a guest or observer. So much is the love for Muslims of the Indian subcontinent that Pakistan will go to any extent to deny them any benefits they may derive from the good work of OIC.

The hypocrisy of Pakistan probably gets best exposed in the dealing of its all-weather ally China, with the Muslim citizens of China. The establishment of Pakistan or for that matter the entire state of Pakistan goes silent on the treatment of Muslims, their beloved Ummah, in the Xinjiang region of China. The Uighurs, have seen the worst form of religious prosecution, with China denying them even the basic right to worship and follow their religion. As per UN estimates, around a million Uighurs have been detained by Chines authority. The number and size of the detention camps has expanded rapidly since 2016, with estimates ranging from 180 centres to more than 1,000. Foreign news outlets and human rights groups have reported physical and psychological abuse on a massive scale. (6) This gross violation of Human rights, especially of the Muslims has seen zero response from the self-claimed protector of Muslims and Ummah; Pakistan. The leaders of Pakistan who have never shied away from taking the credits of the victorious Muslims rulers from the various parts of the world including claiming the glorious past of Caliphates as the part of their own history under the umbrella of Ummah, conveniently forget the same spirit of Ummah, when it comes to talk about the brutal atrocities on the Muslims of China.

The current Pakistan not only has failed as a nation state but has also failed on the very core principle on which it was created: Islam. Pakistan has clearly demonstrated that a nation state on the basis of religion is a failed experiment and at the best is a creation of a rogue nation and should be lesson to all those who are sympathetic to the killing in name of jihad and for a global Islamic supremacy, ignoring the most important verse from the Holy Quran ‘Killing of an innocent is killing of all humanity’ Quran verse 5:32

With Crackdown on Yasin Malik, India Has Officially Acknowledged Genocide of Kashmiri Pandits. Yasin Malik and several other members of his outfit have been accused of heinous crimes such as targeted killings, gang rapes, assaults and arson to drive Kashmiri Pandits out of the Valley.

The tweet of Mehbooba Mufti condemning the arrest of dreaded terrorist Yasin Malik and ban on JKLF was a surprise if not a shock. She was defending a man and his organisation that had kidnapped and threatened to kill her sister. 


Mahatma Gandhi once said, “The true measure of any society can be found in how it treats its most vulnerable.” This thought has been most abused by the self-claimed Gandhian, Yasin Malik. The name still brings the chills to Kashmiri Pandits and the victims of his terror acts. He, along with members of JKLF, unleashed terror on the minuscule minority community of Kashmiri Pandits. He and several other members of his outfit have been accused of heinous crimes such as targeted killings, gang rapes, assaults and arson to drive Kashmiri Pandits out of the Valley.

Hundreds of Pandits were killed, raped and tortured in a way that this country had never seen before. The government of the day looked away, giving him and his men a free hand to continue the genocide of Kashmiri Pandits. 

With the Farooq Abdullah government turning a blind eye, Yasin and his men dared to successfully kidnap the daughter of then home minister Mufti Mohammed Syed. The kidnapping brought down to its knees the weak central government headed by VP Singh and they released five dreaded terrorists as part of the ransom agreement. The release was a watershed in the insurgency in Kashmir. It opened up the floodgates to the subsequent genocide of Kashmiri Pandits. Yasin and his men were so emboldened that within a few days of the release of their fellow terrorists, they went ahead and shot dead four unarmed Air Force personnel who were waiting for a bus to go to work.

By the end of January 1990, Yasin Malik and his JKLF had ensured that the Valley was bereft of Kashmiri Pandits. Newspapers carried advertisements by terrorists, threatening the Hindus of the Valley to leave in 72 hours or face the consequences. Posters were pasted outside homes of Pandit families with threats that their womenfolk would be kidnapped, raped and converted if they did not leave. As a part of this agenda, Sarla Bhat, a nurse at Kashmir’s premier medical institution SKIMS, was gang-raped and cut to pieces, political leader Tikkalal Taploo, Justice Ganjoo, and the then Doordarshan Kendra director Lassa Kaul — all of them were murdered in broad daylight. The list of killing and rapes runs into hundreds.

The man after seeing his objective of driving Pandits away from Kashmir fulfilled somehow found a way to befool the government and avoid punishment. He declared that he turned “Gandhian” to continue his struggle against India. So enamoured were few media houses with his newfound love for Gandhi that they even called him a youth icon. The government continued to turn a blind eye to his crimes and awarded him with a passport. He travelled to Pakistan with this passport and shared the stage with Hafiz Saeed, the chief of the same organisation that has bled India dry — Lashkar-e-Toiba.

But how long can a chameleon hide his true colours? At a 2009 event on Kashmir in Delhi, Yasin Malik thundered, “Give us independence or don’t hold us responsible if we pick up the guns again.”

This statement violated the basic thought of Gandhian ways of non-violence. Gandhi’s dislike for violence was so severe that he halted the successful non-cooperation movement on the national level in 1922, the moment it turned violent at Chauri-Chaura. But this self-claimed Gandhian continued to wage a war against India, by instigating stone pelting, arson and rioting in 2010. The stone pelting incidents in 2010 led to the death of more than a hundred.

He led the mobs in destroying and burning government buildings and schools and in attacking security forces. The act was repeated with the same impunity in 2016. Yasin Malik, who is part of the infamous JRL (Joint Resistance Leadership) of Kashmir, has endorsed every act of terror by the terrorists of JeM, LeT, Hizbul and other terrorist groups in Kashmir. While protests have been called to mourn the death of terrorists, the same JRL has kept mum on the death of innocent civilians by terrorist groups.

Yasin Malik has always maintained the he is proud of the fact that he took up the gun because without that, the Kashmir issue would not have gained attention. Not even once has he expressed remorse for his actions and never condemned the reign of terror unleashed by other terror groups. In an interview with a foreign news channel, he proudly defended the killing of the air force officers, calling them his enemies. The enemy being the Indian state. This Gandhian romanticises power of the gun, violence and deaths.

In this context, the drafting of the statement issued by Home Secretary Rajeev Gauba, while announcing a ban on his outfit, is welcome. The fact that he acknowledged, “Yasin Malik was the mastermind behind the purging of Kashmiri Pundits from the Kashmir Valley and is responsible for their genocide,” is a huge step forward. It is perhaps for the first time that India has officially acknowledged what happened to us as a ‘genocide’ and we hope this won’t be the last step in exposing people like him and giving us long overdue justice.

NEW DELHI: Continuing its crackdown on separatist elements in Jammu & Kashmir, the Government on Friday banned the  Jammu Kashmir Liberation Front (JKLF) led by Yasin Malik as an unlawful association for its extremist orientation and violence against the Hindu minority in the Valley.

The ban under the Unlawful Activities (Prevention) Act is on the grounds that JKLF had spearheaded separatist ideology in Kashmir and triggered the exodus of Kashmiri Pandits by murdering members of the minority community in the late eighties.

“Malik was the mastermind behind the purging of Kashmiri Pandits and is responsible for their genocide. The JKLF has many serious cases registered against it. This organisation is responsible for murder of four IAF personnel and kidnapping of Rubaiya Sayeed, daughter of the then Union home minister Mufti Muhammad Sayeed in the V P Singh government,” home secretary Union Rajiv Gauba said.

19/01/90: When Kashmiri Pandits fled Islamic terror - Kanchan Gupta

Srinagar, January 4, 1990. Aftab, a local Urdu newspaper, publishes a press release issued by Hizb-ul Mujahideen, set up by the Jamaat-e-Islami in 1989 to wage jihad for Jammu and Kashmir's secession from India and accession to Pakistan, asking all Hindus to pack up and leave. Another local paper, Al Safa, repeats this expulsion order.

In the following days, there is near chaos in the Kashmir valley with Chief Minister Farooq Abdullah and his National Conference government abdicating all responsibilities of the State. Masked men run amok, waving Kalashnikovs, shooting to kill and shouting anti-India slogans.

Reports of killing of Hindus, invariably Kashmiri Pandits, begin to trickle in; there are explosions; inflammatory speeches are made from the pulpits of mosques, using public address systems meant for calling the faithful to prayers. A terrifying fear psychosis begins to take grip of Kashmiri Pandits.

Walls are plastered with posters and handbills, summarily ordering all Kashmiris to strictly follow the Islamic dress code, prohibiting the sale and consumption of alcoholic drinks and imposing a ban on video parlours and cinemas. The masked men with Kalashnikovs force people to re-set their watches and clocks to Pakistan Standard Time.

Shops, business establishments and homes of Kashmiri Pandits, the original inhabitants of the Kashmir valley with a recorded cultural and civilisational history dating back 5,000 years, are marked out. Notices are pasted on doors of Pandit houses, peremptorily asking the occupants to leave Kashmir within 24 hours or face death and worse. Some are more lucid: "Be one with us, run, or die!"

Srinagar, January 19, 1990. Jagmohan arrives to take charge as governor of Jammu and Kashmir. Farooq Abdullah, whose pathetic, whimpering, snivelling government has all but ceased to exist and has gone into hiding, resigns and goes into a sulk. Curfew is imposed as a first measure to restore some semblance of law and order. But it fails to have a deterrent effect.

Throughout the day, Jammu and Kashmir Liberation Front and Hizbul Mujahideen terrorists use public address systems at mosques to exhort people to defy curfew and take to the streets. Masked men, firing from their Kalashnikovs, march up and down, terrorising cowering Pandits who, by then, have locked themselves in their homes.

As evening falls, the exhortations become louder and shriller. Three taped slogans are repeatedly played the whole night from mosques: 'Kashmir mei agar rehna hai, Allah-O-Akbar kehna hai' (If you want to stay in Kashmir, you have to say Allah-O-Akbar); 'Yahan kya chalega, Nizam-e-Mustafa' (What do we want here? Rule of Shariah); 'Asi gachchi Pakistan, Batao roas te Batanev san' (We want Pakistan along with Hindu women but without their men).

In the preceding months, 300 Hindu men and women, nearly all of them Kashmiri Pandits, had been slaughtered ever since the brutal murder of Pandit Tika Lal Taploo, noted lawyer and BJP national executive member, by the JKLF in Srinagar on September 14, 1989. Soon after that, Justice N K Ganju of the Srinagar high court was shot dead. Pandit Sarwanand Premi, 80-year-old poet, and his son were kidnapped, tortured, their eyes gouged out, and hanged to death. A Kashmiri Pandit nurse working at the Soura Medical College Hospital in Srinagar was gang-raped and then beaten to death. Another woman was abducted, raped and sliced into bits and pieces at a sawmill.

In villages and towns across the Kashmir valley, terrorist hit lists have been floating about. All the names are of Kashmiri Pandits. With no government worth its name, the administration having collapsed and disappeared, the police nowhere to be seen, despondency sets in. As the night of January 19, 1990, wears itself out, despondency gives way to desperation.

And tens of thousands of Kashmiri Pandits across the valley take a painful decision: to flee their homeland to save their lives from rabid jihadis. Thus takes place a 20th century Exodus.

Srinagar, January 19, 2005. There are no Kashmiri Pandits in Srinagar, or, for that matter, anywhere else in the Kashmir valley; they don't live here anymore. You can find them in squalid refugee camps in Jammu and Delhi. As many as 300,000 Kashmiri Pandits have fled their home and hearth and been reduced to living the lives of refugees in their own country.

Two-thirds of them are camping in Jammu. The rest are in Delhi and in other Indian cities. Many of them, once prosperous and proud of their rich heritage, now live in grovelling poverty, dependent on government dole and charity. In these 15 years, an entire generation of exiled Kashmiri Pandits has grown up, without seeing the land from where their parents fled to escape the brutalities of Islamic terrorism, a land they dare not return to, although that land still remains a part of their country.

A large number of them are suffering from a variety of stress and depression related diseases. A group of doctors who surveyed the mental and physical health of the Kashmiri Pandits living in refugee camps, found high incidence of 'economic distress, stress induced diabetes, partial lunacy, hypertension and mental retardation.' Statistics reflect high death rate and low birth rate among the Kashmiri Pandit refugees.

And thereby hangs a tragic tale that has been all but wiped out from public memory.

An entire people have been uprooted from the land of their ancestors and left to fend for themselves as a weak-kneed Indian state shamelessly panders to Islamic terrorists and separatists who claim they are the final arbiters of Jammu and Kashmir's destiny. A part of India's cultural heritage has been destroyed; a chapter of India's civilisational history has been erased.

Had this tragedy occurred elsewhere in Hindu majority India, and had the victims been Muslims, we would have described it as 'ethnic cleansing' and 'genocide.' We would have made films with horror-inducing titles. We would have filed cases in the Supreme Court of India. Our media would have marshalled remarkable rage in reporting the smallest detail.

But, this tragedy has occurred in Muslim majority Kashmir valley, and the victims are all Hindus, that too Pandits. What has been lost is part of India's Hindu culture, what has been erased is integral to India's Hindu civilisation.

Therefore, the government makes bold to record that the Kashmiri Pandits have "migrated on their own" and their 'displacement (is) self-imposed;' the National Human Rights Commission, after a perfunctory inquiry, refuses to concede that what has happened is 'genocide' or 'ethnic cleansing,' though facts add up to no less than that, never mind that 300,000 lives have been destroyed.

And, our jhola-wallah brigade of secular activists rudely turn up their noses to the plight of Kashmiri Pandits: Hindu sorrow, inflicted by Islamic terror, stinks.

Today, on January 19, the 15th anniversary of the forced flight of Kashmiri Pandits, look back at India's wretched history of secular politics and consider the terrible price the nation has paid at the altar of appeasement because the Indian State has, and continues to, toe the line of least resistance.

This is the view of seasoned journalist and veteran Kashmir-watcher---- Ghulam Mohammad Sofi, The Editor Srinagar Times


Q: As per a survey by Kashmir Images, a weekly published in Kashmir, 68 per cent Muslims believe that Pandits betrayed them in their hour of distress. Do you agree?

Sofi: No, I am not in agreement at all. The Kashmiri Pandits were not in a position to help in any way. They were compelled to leave their homes, their jobs, and their land overnight. So what is this betrayal all about?

Q: The reference obviously is to suffering of common Muslims in the street during cordon-cum-search operations, crackdowns and arbitrary arrests resorted to by the security forces to control the militancy. Have they not been wronged?

Sofi: Majority community should understand that they are the victims of a proxy war. This war was neither been engineered nor supported by Pandits. In fact they were the first victims of the scheme which forced them to leave the state. Therefore this is an unfair "charge" against Pandits.

Q: The political chief of Jamaat-i-Islami says that not a single cadre of his "Jamat" was responsible for Pandit killings. What is your view?

Sofi: (Smiles): Technically he may be right. Even today they claim that there is no connection between the present killings and Jamat-i-Islami. But the ground realities should also support their views.

Q: Most people in the Valley blame Mr. Jagmohan, the erstwhile Governor of the state, for encouraging the Pandit flight. Do you agree?

Sofi: It is a total lie. It is a part of systematic propaganda. The Pandit flight from the Valley was the sequel to a plan hatched well in advance from the state. It had nothing to do with Jagmohan.

Q: Why could Mr. Jagmohan not organise Pandit camps in some among the 30-odd military stations in the Valley itself?

Sofi: The situation was too bad for Jagmohan when he assumed office. Mr Rajiv Gandhi (not prime minister then) came for an overnight visit. Both I and Jagmohan were present in Centaur Hotel in the lake. Rajiv Gandhi said, "Kashmir is slipping away from us". Such was the situation for Jagmohan. Even Mr. M.L. Fotedar and the then Dy. Prime Minister, Mr Devi Lal, were accompanying Rajiv Gandhi when he said so.

Q: What was the problem in housing the Pandits in makeshift barracks, schools, dharmshalas, institutional army buildings close to military stations? The whole race of Pandits would have been saved the tragedy of deserting their homeland?

Sofi: One has to appreciate the January 1990 situation in the Valley. Jagmohan stayed in Jammu for one night. He took a flight from Jammu and arrived in Srinagar Raj Bhavan the next day. He called some of his friends. He called me too. Had I known that the situation was as bad as it later turned out to be, frankly, I would not have gone to Raj Bhavan. There were just three people in the room when I arrived in Srinagar Raj Bhavan. He offered a cup of tea to me but there was nobody to bring one. I saw him go towards the kitchen three times; presumably, he made the tea himself. There was no administration worth the name anywhere in the state, I mean in the Valley. The police stations all over the Valley were centres of operation for the militants. Jagmohan could not have done anything. Nearly 32,000 Kashmiri Pandits' houses have been burnt since 1991. Is there Jagmohan's hand in this too? People like you, even in 1997, need courage to come to the Valley. Otherwise it is still not safe here. Look what happened in Sangrampura in March 1997 when seven Pandits were mercilessly gunned down.

Q: What is your opinion of the Kashmir Images Survey in which 76% Muslims population wanted the Kashmiri Pandits back in the Valley?

Sofi: The fact is that even today your erstwhile neighbours wish that you all should come back. They would even extend warm hospitality to you when you visit them. But even they will be harbouring a sense of fear while dealing with Pandits. We all need to wait for normalcy which is not yet in sight.

organized a public session on "The facts and feelings about Kashmiri Pandits" on 24th February, 2018 at Modasa, Gujrat, where hundreds of people assembled to pledge their support to the Kashmiri Pandit cause. The session had Roots in Kashmir activists, Sh. Sushil Pandit and Sh. Amit Raina adressing the gathering. While Amit Raina spoke about the fast losing identity of Kashmiri Pandits and encroachment of Temples, Sushil Pandit higlighted the pain and struggle of Kashmiri Pandits in both pre and post exodus days. He also highlighted the broken promises of succesive governments in getting Kashmiri Pandits their homes back with justice and dignity. He requested people of Gujarat to force their representatives to push the government in Delhi to not succumb to the pressures of PDP and the love of power.

Sh. Jogender Upadhyay, from the Madosa Brahm Samaj assured Kashmiri Pandits of support from all people of Gujarat, especially from the 65 lakh Brahmin Community.

Modasa Brahm Samaj also passed a resolution covering the following points:

1.  Abolishing Article 370 and 35 (A)

2. Kashmiri Pandits are the aborigines of Kashmir valley; they should get the status of Native (Schedule Tribe) and Minority for the protection of their religious and ethnic rights.

3. To immediately establish a Kashmiri Pandit’s Commission for the purpose of social justice and legislative empowerment of Kashmiri Pandits

4. To appoint two members in state legislative assembly and one member in Rajya-sabha from the Kashmiri Pandit community. To allocate separate district for their safe rehabilitation in the Kashmir valley.

5.The names of the ancient villages, towns, religious places and monuments of the Kashmir Valley should not be changed.

6. Temples and religious places in the Kashmir valley are heritage of Indian culture therefore the “Temple and Shrine Protection Bill' should be implemented immediately to stop the encroachment of temple land and premises

Sorry, you are late. Justice denied

The Honorable Supreme Court recently dismissed a Public Interest Litigation (PIL) filed by Roots in Kashmir (RIK). RIK in its PIL had asked for:

1.            Investigation and prosecution of terrorists like Yasin Malik and Farooq Ahmed Daar @ Bitta Karate, Javed Nalka and others, for hundreds of FIR’s of murders of Kashmiri Pandits during 1989-90, 1997 and 1998, and which are lying un-investigated by J&K Police even after expiry of 26 years. 

2.            Transfer of all the FIR’s/cases pertaining to murders of Kashmiri Pandits, from State of J&K to some other State (preferably State of NCT of Delhi), so that the witnesses, who were reluctant to approach police or Courts in view of their safety concerns, can freely and fearlessly come and depose before Investigating agencies and Courts.

3.            Transfer of investigation of all the FIR’s/cases of murder and other allied crimes against Kashmiri Pandits in year 1989-90, 1997 and 1998, to some other independent investigating agency like CBI or NIA or any other agency as appointed by this Court, as till date J&K police has failed miserably to make any progress in hundreds of FIR’s lying pending with them for more than 26 years.

4.            Appointment of some independent Committee or Commission to investigate into the mass-murders and genocide of Kashmiri Pandits during 1989-90 and subsequent years, and also to investigate the reasons for non-prosecution of FIR’s of murders of Kashmiri Pandits and Court-monitored-investigation so that the hundreds of FIR’s can reach their logical conclusion without any further delay.  

5.            Completion of trial and prosecution of Yasin Malik for gruesome murder of 4 officers of Indian Air Force on morning of 25th January 1990, which is currently pending before CBI Court in Ajmer and presently not being prosecuted or followed-up by Indian Air Force. And it should be a matter of shame for the Government of Union of India that 4 of its officers of Indian Air Force were murdered by gun-shots in broad daylight by JKLF terrorist Yasin Malik on 25th January 1990, with many eye-witnesses present there, and till date the charges are not framed in the said case, let alone the punishment. 

The Honorable Court in its order headed by that a bench of Chief Justice JS Khehar and Justice DY Chandrachud said '... the instances referred in the petition pertain to the year 1989-90, and more than 27 years have passed by since then. No fruitful purpose would emerge, as the evidence is unlikely to be available at this late juncture.'  

The order from Supreme Court surprised not only the displaced community but even many legal Pundits. The Honorable  Court surprisingly threw the burden upon the victims on getting a closure instead  of prosecuting and investigating agencies of both the Central and State governments, which have failed miserably in bringing the cases to closure. 

What the Honorable Apex Court apparently missed to notice is that Kashmiri Pandits were ethnically cleansed and erased from their land of their ancestors, and the first and logical effort of such community will be their fight for survival. The community took time to rebuild itself from scratch. The survival of existence was more important than battle of justice, because dead men can’t approach court for justice. 

What makes many wonder is why did J&K High Court or Supreme Court not take suo-motu cognizance of offences itself, when it could take suo-motu cognizance of a murder case of ‘lynching by cow-vigilantes.’     If trial of Bilkis Yakub Rasool gang rape case could be shifted out from Gujarat to Mumbai on the apprehension of the victim and the witnesses could come to harm if the trial was held in Gujarat, why didn’t the Honorable Apex Court appreciate that same stands true for the witnesses and victims of terrorism in the troubled state of Jammu & Kashmir. 

The court missed the basic point, that it is not the Kashmiri Pandits that are in delay. It is Central and State Government that are in delay, it is the courts of this country that have delayed in delivering justice. 

The Supreme in its order while mentioned that 27 years is too late for Kashmiri Community to seek justice, they did not appreciate the fact that community approached every organ of the executive to get justice delivered. They did not appreciate that every political party that came to power in Centre or State, kept promising that they will get justice soon. Many of the cases are pending in various courts without any closure. The Supreme Court conveniently ignored that a victim will approach Supreme Court only after all doors of Justice are closed and that does not happen immediately.  

Supreme Court did not appreciate that 1984 Sikh riots case, which is more than 32 years old, is still to see a final closure, and was opened much later after its occurrence. Ram Janambhoomi – Babri Masjid case is pending since decades, and the recent reopening of cases against top BJP Leaders for Babri Masjid demolition, after the gap of 25 years, should have met the same fate as ours plea. But it was otherwise. A depilated building deserves justice but not 5 lakh Kashmiri Pandits.

Honorable Supreme Court posed a question to the petitioner that how the police will collect evidence after 27 years? A little surprising, because then what made Court believe police or CBI will get evidence in Sikh Riots of 1984 by an unknown mob. In the cases of murders of Kashmiri Pandits, eye witnesses and immediate family members of the victims are still alive. But where should they go to give evidence, when the police is not working and unfortunately the Courts are not interested, and the cases are in areas where he has threat to life.  

In 2014, almost 23 years after it was reported, the trial court in J&K directed state government to further investigate the infamous Konan Poshpora mass rape case. Inspite of multiple probes dismissing the allegations as false, the court while dismissing the revision petition filed by the Indian Army said "crime never dies". The court said that a “delay in investigation” doesn’t debar an investigating agency from “unraveling the truth

In 1999, Government of India, appointed Mukherjee Commission, headed by a retired Supreme Court Justice,  to investigate the death of Subash Chandra Bose, 54 years after his death. Netaji Bose, the great freedom fighter of India, went missing in a foreign country and has been believed to be dead in a plane crash. The retired justice did not for a moment say that where will the evidence come from after 54 years, that too from an investigation which would be spread over few countries. But today the Honorable Supreme Court informed us that it is impossible to gather evidence of killing of 700 people who were killed over period in the last 27 years, in a territory which is a part of Union of India. 

Bangladesh in 2015 executed perpetrators of war crimes committed in 1971, 45 years later. Is the honorable court trying to convey that Bangladesh's legal and justice system better than India? While Israel continued to hunt their Nazi persecutors for 50 years, our system wants us to believe that justice is time bound, and now 700 murders will go unpunished and unnoticed from the history of the largest Democracy in the World. 

Today’s dismissal of PIL by Supreme Court has practically killed all the hopes of any justice to a marginalized community; a community which chose to lose everything but not its love for mother India and its constitution. Today the killers of the community must be gleaming over the fact that they are above everyone else, with a slight regret, “why did we not kill more?”
