यासीन के कारनामों की कम नहीं दास्तान!

संदीप देव, नई दिल्ली जम्मू कश्मीर लिबरेशन फ्रंट (जेकेएलएफ) के नेता यासीन मलिक के इतिहास पर पर्दा डालने के लिए भले ही गृह मंत्रालय उसके कारनामों के प्रति अनभिज्ञता जाहिर करे, लेकिन उसकी दास्तान जम्मू-कश्मीर के 12 थानों में आज भी दर्ज है। हत्या, अपहरण, हत्या के प्रयास जैसे मामले तो उस पर दर्ज हैं ही-फेरा, हवाला, टाडा व पोटा कानून के तहत देशद्रोह जैसे मामलों में भी वह कई वर्षो तक सलाखों के पीछे रह चुका है। ताज्जुब यह है कि गृह मंत्रालय के कश्मीर डिविजन के पास इसकी जानकारी तक नहीं है। यासीन पर जम्मू-कश्मीर के अलग-अलग थानों में 23 आपराधिक मामले दर्ज हैं। इसके बावजूद वह कई वर्षो से अपनी राजनीतिक हैसियत स्थापित करने में लगा है। हालांकि, हकीकत यही है-केंद्र भले ही अनजान, यासीन के कारनामों की कम नहीं है दास्तान। केंद्र सरकार सूचना के अधिकार कानून का माखौल किस तरह से उड़ा रही है, इसकी बानगी यासीन मलिक मामले में देखने को मिलती है। उस पर दर्ज आपराधिक मामले और उसके खिलाफ चल रहे मुकदमे की जानकारी से संबंधित एक आरटीआई के जवाब में सरकार ने कहा है कि गृह मंत्रालय के कश्मीर डिवीजन के पास यासीन से संबंधित कोई सूचना नहीं है। दैनिक जागरण ने मंत्रालय की इस सूचना का पर्दाफाश करने के लिए विश्र्वसनीय स्रोत के जरिए यासीन पर दर्ज 23 आपराधिक मामलों की जानकारी हासिल की है। इसमें जम्मू-कश्मीर उच्च न्यायालय के जज नीलकंठ गंजू, पूर्व गृहमंत्री मुफ्ती मोहम्मद सईद की पुत्री रुबिया सईद की पुत्री का अपहरण और एयरफोर्स के चार निहत्थे जवानों, भाजपा नेता टिकलाल टपलू, दूरदर्शन के निदेशक लसाकोल एवं नर्स सरला की हत्या जैसे बहुचर्चित मामले भी शामिल हैंै। हालांकि जम्मू कश्मीर के पुलिस महानिदेशक कुलदीप खुड्डा ने जागरण से बातचीत में स्वीकार किया है कि यासीन मलिक के खिलाफ कई मामले दर्ज हैं और उस पर ट्रायल चल रहा है। वर्तमान में वह जमानत पर जेल से बाहर है। उधर, उधमपुर- कठुआ के कांग्रेस सांसद लाल सिंह का कहना है-यासीन मलिक एक देशद्रोही है, जिसे सरकार ने छोड़ रखा है। इससे अधिक वह और क्या कह सकते हैं।

संदीप देव, [नई दिल्ली]। यासीन मलिक, जम्मू कश्मीर लिबरेशन फ्रंट [जेकेएलएफ] का वह नेता, जिसके डर से कभी कश्मीर घाटी थर्राती थी..जो कभी कश्मीरी पंडितों के लिए आतंक का दूसरा नाम था.. जिस पर तत्कालीन गृह मंत्री मुफ्ती मोहम्मद सईद की बेटी रूबिया सईद के अपहरण और एयरफोर्स के चार निहत्थे जवानों को सरेआम गोलियों से भूनने का मामला आज भी लंबित है..! आपको जानकार आश्चर्य होगा कि केंद्र सरकार यासीन मलिक के इन काले कारनामों से अनजान है! हालांकि सरकार के इस झूठ का पुलिंदा सीबीआई की एक रिपोर्ट से जाहिर हो जाती है!
'रूट इन कश्मीर' के सक्रिय कार्यकर्ता रशनीक खेर द्वारा सूचना के अधिकार के तहत यासीन मलिक पर दर्ज मुकदमे के संबंध में मांगी गई जानकारी के जवाब में गृह मंत्रालय ने कहा है कि ऐसी कोई जानकारी मंत्रालय के कश्मीर डिवीजन के पास नहीं मौजूद नहीं है। सरकार के इस झूठ का पर्दाफाश उस वक्त हो गया जब एक अन्य आरटीआई के जवाब में सीबीआई ने यासीन मलिक पर दर्ज दो हाई प्रोफाइल मामले की जानकारी दी। सीबीआई की रिपोर्ट के मुताबिक यासीन मलिक पर जम्मू की टाडा अदालत में एयरफोर्स पर्सनल मर्डर केस /90-एससीयू.वी/एससीआर-2) एवं डा. रूबिया सईद अपहरण (7(एस/90-एससीयू.वी/एससीआर-2)) का मामला लंबित है। इन दोनों मामलों में पिछले 18 साल से यासीन मलिक के खिलाफ आरोप तय नहीं हुआ है और तो और यासीन मलिक को सरकार ने पासपोर्ट भी जारी किया हुआ है, जिस पर वह अमेरिका तक की यात्रा कर चुका है। महत्वपूर्ण है कि यदि किसी व्यक्ति पर आतंकी गतिविधियों में संलिप्त होने का मामला दर्ज है तो उसे पासपोर्ट एक्ट के तहत पासपोर्ट जारी नहीं किया जा सकता है। इस संबंध में पूछे गए सवाल पर गृह मंत्रालय का जवाब है कि यासीन मलिक को राज्य सरकार व सीआईडी की संस्तुति पर पासपोर्ट जारी किया गया है।
ज्ञात हो कि 8 दिसंबर 1989 को जब तत्कालीन गृह मंत्री मुफ्ती मोहम्मद सईद की बेटी डा. रूबिया सईद का जेकेएलएफ के आतंकियों ने अपहरण कर लिया था। उसे छुड़ाने के एवज में सरकार को चार खूंखार आतंकियों को रिहा करना पड़ा था। इसी तरह 25 जनवरी 1990 को एयरफोर्स के चार जवानों को कश्मीर के एक बस स्टैंड पर जेकेएलएफ के आतंकियों ने गोलियों से भून दिया था। चारों निहत्थे जवान बस पर चढ़ने के लिए खड़े थे। दोनों मामले में सीबीआई ने यासीन मलिक के खिलाफ टाडा अदालत में चार्जशीट दाखिल कर रखा है, लेकिन मुकदमे में जानबूझ कर की जा रही देरी का नतीजा यह है कि उसके खिलाफ आज तक आरोप भी तय नहीं हो सका है। ज्ञात हो कि इसी तरह से जेकेएलएफ के एक अन्य आतंकी बिट्टा को 16 वर्ष जेल में रखने के बावजूद चार्जशीट तक फाइल नहीं किया गया था। सरकार ने उसे पैरोल पर छोड़ा और उसके बाद से वह गायब है।

From 1989 to 2002, Malik has 23 criminal cases pending against him. Despite the provisions of the Passport Act of 1967 prohibiting it, his passport is renewed every year by the central government and he often travels abroad with the permission of courts.

Two months apart, a young woman and four IAF officers were on two different roads in Srinagar when militants swooped in. Weeks and months apart over the past two decades, ordinary Kashmiris were raped, killed and brutalised.
The young woman was 23-year-old Rubaiyya Sayeed, daughter of Mufti Mohammed Sayeed, then Home Minister of India. She was heading home in a bus after her day as an intern from a hospital on an icy afternoon on December 8, 1989, when she was abducted. She was released after a 122-hour crisis.
Then, on January 25, Squadron Leader RK Khanna and three other IAF men were waiting for a pick-up when they were sprayed with bullets.
Two decades later, no one has been convicted in the two cases and in most others related to the insurgency in Kashmir. A huge number of trials have not even begun.
This is the great judicial tragedy of Kashmir — a mountain of pending cases, never fast-tracked or retried despite precedents being set now — most prominently after the Gujarat riots. These include human rights violations by security forces to disappearances, rapes; and numerous cases of murder and arson involving Kashmiri Pandits.
“We need fast track courts for such cases. Letting them linger in court is to let wounds fester. It is cancerous,” said leading Supreme Court lawyer KTS Tulsi. “Courts must deal with these cases with a sense of urgency. Traditionally, in areas of conflict, the judiciary has taken a backseat. Even in Punjab or Assam, the judiciary did not discharge its proper responsibility.”
The accused include a range of influential people — from soldiers and officers in the army, paramilitary forces and police accused of human rights abuses to separatist leaders like Yasin Malik, a former militant leader accused in both the Rubaiyya Sayeed and IAF killing cases.
“Fast track courts are needed for cases like rapes in rural areas by security forces, custodial killings, disappearances,” said leading J&K lawyer Zafar Shah, who also represents Malik and the other accused in the Rubaiyya Sayeed and IAF cases. “But the Armed Forces Special Powers Act, which is in force here, requires central government permission before trials.”

“It has to be acknowledged: there has been conviction in only a handful — maybe less than 10 — such cases affecting Kashmiri Muslims and Pandits, although tens of thousands of people have died,” said a senior security official.
“Politics requires that these cases must linger. But that is hardly a long term strategy,” said Tulsi.

Rubiya Syed kidnapping case Yasin Malik among others appear in TADA court

JAMMU, Jan 3: The accused involved in the much publicized Rubiya Syed kidnapping case appeared in the Court of TADA today. However, all the cases including that of one lakh US dollar were adjourned because of the strike of the advocates.
The alleged accused appeared in the TADA court were Jammu and Kashmir Liberation Front (JKLF) supremo Mohd Yaseen Malik, Showkat Ahmed Bakshi, Ali Mohd Mir, Javid Mir alias Nalka, Mehraj-ud-Din Sheikh, Mohd Iqbal Gandroo, Mohd Zaman Mir and Farooq Ahmed Dar alias Bitta-Karate.
Other accused Mohd Yaqoob Pandit, Wajahat Bashir Qureshi, Manzoor Ahmed Sofi and Mohd Rafiq alias Nanaji were absent and their names were exempted from hearing on the application filed on their behalf.
The most important case which was listed for hearing today was of kidnapping of Dr Rubiya Syed, daughter of the then Union Home Minister Mufti Mohd Syed.
The other listed cases were killing of five Air Force officials at Batmaloo on January 1990 and seizure of one lakh US dollars meant for the JKLF supremo.
It is worthwhile to mention here that the cases of kidnapping of Dr Rubiya Syed and killing of Air Force personals have been pending before the Court for the last more than 15 years as all the alleged accused involved in the cases were not appearing before the Court.

Pak sets free 4 hijackers
ISLAMABAD, Jan 3: Pakistan today freed four Palestinians convicted of the 1986 hijacking of an American airliner in Karachi that ended with the death of 22 people including an Indian flight purser Neerja Bhanot, who helped passengers aboard escape.
The hijackers, who were sentenced to life imprisonment, were set free from Adiala jail in Rawalpindi and put on an international flight to the Gulf region, local TV channels reported.
A group of Palestinians hijacked a Pan Am Boeing 747 carrying 400 passengers while it was being parked at the Apron in Karachi in September 1986. The cockpit crew escaped through the emergency hatch but senior flight purser Bhanot stayed on helping passengers escape.
Twenty-two people, including Bhanot, died when Pakistani commandos stormed the flight to end the 16-hour siege. Bhanot was awarded Ashok Chakra posthumously by the Indian Government. She was at that time the youngest and till date the only woman Ashok Chakra awardee.
The Palestinians were handed down the death penalty during the regime of late Gen Zia-ul-Haq for hijacking the plane. One of the hijackers, who was injured in the commando operation, died in jail.
The sentence of the others was later converted to life imprisonment in 1988 when slain Premier Benazir Bhutto was in power.(PTI)
